NLP was appointed by TM Ward Ltd following the decision by Darlington Borough Council to refuse planning permission for the change of use of a former steel foundry on an industrial estate in Darlington to a materials recycling centre. The application site was located on an established industrial estate but adjacent to a residential area. The application was refused as a result of concerns about the impact of the proposal on the amenity of neighbouring commercial and residential properties.
NLP appealed to the Planning Inspectorate, demonstrating that the Council was attempting to duplicate the environmental controls available under other legislation. Evidence was also submitted to show that many of the Council’s other concerns were unjustified and the remainder could be adequately controlled by conditions. The appeal was successful and planning permission was granted.
